You do not have to be a Scottish resident to marry in Scotland. Scottish law allows any two people, regardless of where they live, to marry in Scotland, provided that:

- Both persons are at least 16 years of age.
- They are not related to each other in any way, which would prevent their marriage.
- They are not married. (Any person who has previously been married must produce their decree absolute.)
- They are capable of understanding the nature of the marriage ceremony and of consenting to the marriage.
- The marriage would be regarded as legal in any foreign country to which either party belongs.
- The witnesses must be over 16 years of age and be capable of fully understanding the proceedings.
It is your choice whether you would like a minister or registrar to conduct your ceremony and everything can be done by post prior to your arrival in Gretna Green. If you would like a minister, either the bride or groom must go to the registration office before the wedding (usually the morning of the wedding) to collect the marriage papers in person.
